Peter H. Rachman
Before joining LM&B, Peter was a partner in a national law firm specializing in securities litigation. Prior to attending law school Peter was an independent floor trader at the Chicago Board of Trade. Peter has worked on a variety of securities fraud and breach of fiduciary cases, including having first chair responsibility. Representative cases which reflect the nature and range of issues that Peter has worked on include the following:
• In re Sunbeam Sec. Litig., 89 F. Supp. 2d 1326, 1340-41 (S.D. Fla. 1999) Peter functioned as co-liaison counsel in a shareholder class action alleging widespread accounting fraud which ultimately settled for approximately $140 million;
• Werner v. Miller Technology Management, L.P., 831 A.2d 318 (Del. Ch. 2003) Limited partnership breach of fiduciary duty, violations of partnership agreement, primary author of brief in opposition to motion to dismiss, argued before V.C. Lamb, motion denied in part;
• Gower v. Primavera Laboratories, Inc., Del. Ch. C.A. No. 14387 (2001) Shareholder class action in a going private/majority shareholder situation. First chair for plaintiffs, trial before V.C. Jacobs, case settled post-trial for 9 times amount of pre-litigation offer; and
• In re National Auto Finance Company, Inc. Securities Litigation, 98 Civ. 8767 (S.D. Fla.) Drafted brief to achieve class certification and ultimately a cash settlement in favor of the class members).
