XM Satellite Radio, Inc.
Lovell Stewart Halebian LLP announces that it has filed a class action lawsuit in the Southern District of New York on behalf of all persons and entities in the United States who own (i) a sound recording protected under federal copyright law or under state common law and/or unfair competition law or (ii) a copyrighted musical composition or a portion thereof, or is a beneficial owner of a copyrighted musical composition, that was unlawfully reproduced and/or distributed by Defendant XM Radio’s XM + MP3 service between April 1, 2006 and the present (“Class Period”). The complaint alleges that during the Class Period defendant unlawfully reproduced and distributed Plaintiffs’ copyrighted works in violation of the United States Copyright Act [17 U.S.C. §§ 101, et seq.] and New York state law.
