On February 17, 2021, the Honorable Paul A. Engelmayer granted Defendants motion for summary judgment against all of the First Level Purchaser claims, except those made by one Plaintiff (Ampal) made directly with Glencore, Century, or any other Defendant or co-conspirator. The First Level Purchaser Plaintiffs have appealed this (and other orders merged into the judgment) to the United States Court of Appeals for the Second Circuit.
